HB 18-1381 Summary

• Eliminates the requirement that medical marijuana centers grow 100% of their own marijuana, effective July 1, 2019, allowing them to purchase from optional premises cultivation facilities, infused product manufacturers, and other centers.

• Creates a statewide licensure class system for optional premises cultivation facilities based on square footage, lighting specifications, plant count, or other reasonable metrics, with corresponding fee structures established by the state licensing authority.

• Increases the allowable purchase threshold for medical marijuana centers from 30% to 50% of total on-hand inventory from other licensed centers during a one-year transition period (through July 1, 2019).

• Authorizes the state licensing authority to establish production limitations through license caps, production amount limits by class, or total statewide production limits based on demand and relevant factors.

• Repeals provisions restricting infused product manufacturers from selling non-infused marijuana and eliminates the inventory possession limits tied to registered patient counts for medical marijuana centers.
