HB18-1403 - Stand By Your Ad Act

• Expands disclaimer requirements for independent expenditures to include communications placed on websites, streaming media services, or online forums for a fee, in addition to broadcast, printed, mailed, and delivered communications.

• Applies disclaimer requirements to all candidate committees, political committees, issue committees, small donor committees, political organizations, political parties, and other persons spending over $1,000 per calendar year on political communications, not just issue committees.

• Requires disclaimer statements to conform to federal communications commission standards for broadcast and online video or audio communications regarding content, size, duration, and placement, and allows online disclaimers to be provided via direct link when impracticable to include on the communication itself.

• Establishes enforcement provisions allowing any person who believes a violation has occurred to file a complaint with the secretary of state under existing campaign finance law procedures and sanctions.

• Applies to elections conducted on or after the effective date of the act.
