Courts must make specific findings of fact at sentencing hearings for defendants convicted of offenses involving sexual intrusion or sexual penetration as elements of the crime.

If the court finds that sexual intrusion or sexual penetration occurred, the court must enter a formal finding of rape and state this finding on the record.

"Convicted" is defined to include verdicts of guilty by judge or jury, guilty or nolo contendere pleas, and deferred judgments or sentences.

The bill applies to offenses committed on or after July 1, 2018.
