Department of Corrections must track prison bed vacancy rates monthly across state facilities and private contract prisons, and notify the Governor, Joint Budget Committee, Parole Board, district attorneys, chief judges, state public defender, and Office of Community Corrections when vacancy falls below 2 percent for 30 consecutive days.

When vacancy rate falls below 2 percent for 30 consecutive days, the Department may request information from the Office of Community Corrections about unused community corrections beds (within 72 hours, then weekly), request Parole Board review of inmates within 90 days of mandatory release with approved parole plans, and coordinate with Parole Board to review inmates eligible for conditional release.

The Parole Board must conduct file reviews within 10 days for inmates on notification lists, evaluating institutional behavior, program progress, and release appropriateness.

For inmates within 90 days of mandatory release, the Parole Board may set release dates up to 30 days before the mandatory release date but not sooner than 15 days after file review; for other eligible inmates, release dates may be set no sooner than 15 days after file review.

Notifications to relevant agencies must continue until prison vacancy rate exceeds 3 percent for 30 consecutive days.
