Each local education provider must adopt and implement a written policy and procedure allowing parents to excuse their students from participating in one or more state assessments, with the provider determining whether written notice is required.

Local education providers are prohibited from imposing negative consequences on students or parents when a parent excuses a student from state assessments, including prohibiting school attendance, imposing unexcused absences, or prohibiting participation in extracurricular activities.

Local education providers cannot prohibit students excused from state assessments from participating in activities or receiving rewards that are provided to students for participating in the assessments.

The Department of Education or State Board must notify a local education provider when receiving a parent complaint concerning the provider's implementation of these requirements.

The act takes effect on August 8, 2018, unless a referendum petition is filed, in which case it requires approval by voters at the November 2018 general election.
