SB18-049 Summary

• Extends the prohibition on wireless telephone use while driving from drivers under 18 years old to drivers of all ages

• Increases the penalty for drivers under 18 from $50 to $300 per violation for first offense; second and subsequent violations remain $100

• Expands the definition of prohibited devices from wireless telephones to all mobile electronic devices, including cellular phones, tablets, laptops, wearable devices, and gaming equipment

• Creates an exception for adult drivers (18+) to use mobile electronic devices through hands-free devices while driving

• Removes sentence enhancement provisions that previously applied when violations caused bodily injury or death

• Takes effect July 1, 2018, and applies to offenses committed on or after that date
