Senate Bill 18-054 Summary

• Amends Colorado Revised Statutes 25-27-107 to subject assisted living residence licensing fees to limitations specified in Section 25-3-105(1)(a)(I)(B) effective August 1, 2019.

• Restricts the Department of Public Health and Environment's ability to increase fees on the fee schedule that was in effect on August 1, 2019, requiring any increases to comply with Section 25-3-105(1)(a)(I)(B).

• Maintains existing requirements that fees be sufficient to meet direct and indirect costs of administration and enforcement, and that lower fees be set for facilities with high Medicaid utilization rates.

• Takes effect 12:01 a.m. on the day following the ninety-day period after final adjournment of the general assembly (August 8, 2018, if adjournment sine die occurred on May 9, 2018), unless subject to a referendum petition approved by voters in November 2018.
