Organizations holding special events under Article 48 may bring sealed alcohol beverages onto licensed or unlicensed premises, auction them for fundraising purposes, and remove them from the premises.

All alcohol beverages must remain sealed at all times while on the premises, and the licensee or property owner cannot require or accept fees, percentages, or other financial benefits related to the auction.

Retail value of alcohol beverages donated by licensed retailers does not count against annual purchase limits for those retailers.

Licensed retailers who donate alcohol beverages are not liable for violations of alcohol sales laws committed by the organization or other persons at the event, unless the retailer was involved in or engaged in unlawful acts.

Licensing authorities must consider mitigating factors, including lack of knowledge, when determining whether to hold a licensee responsible for violations committed by the special event organization.
