CO SB068

Creates a new crime of "false reporting of an emergency" as a class 1 misdemeanor, defined as knowingly making a false report of an imminent threat to safety by use of a deadly weapon.

Escalates penalties to class 1 misdemeanor with extraordinary risk designation if the threat causes building evacuation or bodily injury; class 4 felony for serious bodily injury; class 3 felony for death resulting from emergency response.

Requires courts to impose restitution for all emergency response costs including fire, police, emergency medical services, and evacuation expenses upon conviction.

Establishes that intent or capability to commit the threatened act is not a defense to prosecution for false reporting of an emergency.

Allows prosecution in the county where the report was made, communicated to law enforcement, or where law enforcement responded; takes effect July 1, 2018.
