SB18-090 Summary

• Modernizes language in Colorado Revised Statutes Part 2 of Article 2 of Title 14 (formally titled "Rights of Married Women") to apply to all married persons rather than exclusively married women.

• Replaces gender-specific terms including "married woman," "wife," and "husband" with gender-neutral language such as "person," "spouse," "he or she," and "his or her" throughout sections 14-2-201 to 14-2-210.

• Clarifies that all statutory rights regarding property ownership, contracts, legal standing, business operations, and domicile apply equally to all married persons regardless of sex.

• Takes effect at 12:01 a.m. on August 8, 2018, unless a referendum petition is filed within 90 days after final adjournment, in which case it requires approval by voters at the November 2018 general election.

• Constitutes a nonsubstantive change to existing law with no change to legal rights or obligations, only to the terminology used to describe them.
