Beginning September 1, 2018, state agencies must schedule all fee increases to begin on July 1 of a given year, except for emergency increases.

State agencies must submit fee increase proposals to the joint budget committee by February 1 prior to the increase date, including statutory authority, current fee amount, proposed increase amount, reason for increase, and anticipated economic impacts.

A majority of the joint budget committee must approve each fee increase proposal without alteration, and the increase must be included in authorizing legislation that is enacted into law.

State agencies may impose emergency fee increases without prior approval if necessary to comply with state or federal law or to preserve public health, safety, or welfare, but must submit a proposal to the joint budget committee by the next February 1 for retroactive approval.

Any fee increase made on or after September 1, 2018 that does not comply with these requirements is void; the law applies to fees without a statutory amount and supersedes conflicting provisions of law.
