Insurance producers must disclose to consumers that they will receive a commission from the carrier and provide the standard compensation schedule for the product being sold.

Insurance producers may charge a fee for advising clients on individual health benefit plan selection only if they will not receive a commission from the insurer offering the selected plan and provide written disclosure of the fee to the client.

Insurance brokers may charge a fee for advising clients on individual health benefit plans offered on the exchange under the same conditions: no commission from the insurer and written fee disclosure.

Insurance producers and brokers are prohibited from charging fees to assist clients in enrolling in Medicaid or the Children's Basic Health Plan.

The Insurance Commissioner must promulgate rules to implement and administer these fee and disclosure requirements.
