Senate Bill 18-184 Summary

• Creates a new permit category (1)(b) for one-time excavation projects that generate small quantities of construction materials incidental to the project's primary purpose, without requiring a federal, state, county, city, town, or special district contract.

• Requires one-time excavation projects qualifying under the new permit to be clearly defined, of short duration and scope, affect no more than 30 acres, not employ typical mining processing activities, and complete land reclamation within 12 months of permit issuance.

• Mandates that projects generating excess construction materials that are sold or introduced into the construction materials market must obtain a regular permit instead of the expedited one-time excavation permit.

• Sets application fee for the new one-time excavation permit at $400 and annual fee at $200, compared to $898 application and $504 annual fees for existing contract-based special permits.

• Effective date is August 8, 2018, unless a referendum petition is filed, in which case the act becomes effective only upon voter approval at the November 2018 general election.
