SB18-199 Summary

• Increases assault in the first degree against a peace officer to a class 2 felony with mandatory incarceration of at least the maximum sentence up to 2.5 times the maximum sentence

• Increases assault in the second degree against a peace officer to a class 3 felony with mandatory incarceration of at least the maximum sentence up to 2.5 times the maximum sentence

• Increases assault in the third degree against a peace officer from a class 1 misdemeanor to a class 6 felony with mandatory incarceration of at least the maximum sentence up to 2.5 times the maximum sentence

• Takes effect July 1, 2018 and applies to offenses committed on or after that date

• May require a five-year appropriation to cover increased capital construction, operational costs, and parole costs for the department of corrections
