• Prohibits funeral establishment owners and crematory owners from owning nontransplant tissue banks, and vice versa, to prevent conflicts of interest in the handling of human remains.

• Establishes registration requirement for nontransplant tissue banks with the Division of Professions and Occupations by July 1, 2019, including designee appointment, premises description, and contact information.

• Requires nontransplant tissue banks to maintain records for at least three years documenting donor consent, decedent medical history, and chain of custody of human remains.

• Mandates clear disclosure to donors that their remains may be distributed and that the tissue bank will be compensated for distribution services.

• Makes violation of nontransplant tissue bank regulations a misdemeanor punishable by up to $5,000 fine and/or 18 months county jail imprisonment.
