A former Legislative Aide filed a formal complaint on November 28, 2017, alleging Senator Randy L. Baumgardner grabbed and slapped her buttocks on four separate occasions during the 2016 Legislative Session.

Employer's Council conducted an investigation from December 4, 2017, to January 18, 2018, and concluded the victim's complaint was credible and that Senator Baumgardner more likely than not committed the alleged physical harassment.

The investigation also revealed an unprofessional pattern of verbal sexual harassment, including inappropriate comments such as "you look extremely sexy today," violating the General Assembly's workplace harassment policy under Joint Rule 38.

Senator Baumgardner failed to acknowledge wrongdoing or accept responsibility for his behavior, which the Senate found to be incompatible with the high standards and dignity of the Senate and damaging to the State of Colorado.

The Senate expels Senator Randy L. Baumgardner from the Senate for just cause and declares his seat vacant, exercising its constitutional authority to expel members by a two-thirds vote.
