HB 1033 Summary

• Allows municipalities, counties, and city-counties to enact ordinances or resolutions regulating the possession and purchasing of cigarettes, tobacco products, and nicotine products by minors, as well as the sale of these products to minors.

• Adds new authority for city councils and town councils to adopt ordinances regulating nicotine products, and for county commissioners to adopt resolutions regulating possession or purchasing of these products by minors.

• Establishes that local governments are not prohibited from imposing fees, licenses, or special sales taxes on cigarette sales, and restores eligibility for state tax apportionment to jurisdictions previously disqualified for imposing such fees.

• Clarifies that counties and municipalities may levy, collect, and enforce special sales taxes on cigarettes, tobacco products, and nicotine products through voter approval, with provisions for intergovernmental agreements between counties and municipalities to avoid conflicting taxes.

• Takes effect July 1, 2019.
