HB 19-1034 Summary

• Requires railroad common carriers to have at least two crew members aboard freight trains and light engines while the train is moving

• Exempts helper service, passenger/tourism trains, locomotives traveling 30 mph or less outside rail yards with only a caboose attached, hostler service, and trains moving 10 mph or less for loading/unloading purposes

• Defines "crew member" as a carrier employee involved in train operation, excluding hostler service or utility employees and contractors

• Establishes misdemeanor penalties with fines ranging from $250-$1,000 for first offense, $1,000-$5,000 for second offense within three years, and $5,000-$10,000 for third or subsequent offense within three years

• Effective July 1, 2019
