HB 19-1039 Summary

• State registrar shall issue new birth certificates reflecting changed gender designation (male, female, or "X") when person or guardian submits written request and statement confirming sex designation does not align with gender identity.

• For minors under 18, a licensed medical or mental health provider must submit statement confirming minor has undergone gender transition treatment or has intersex condition, or person may provide court order for gender change.

• New birth certificates supersede originals as official public record and shall not be marked as amended or indicate the change occurred; state registrar may only amend gender designation once per request without court order.

• Driver's licenses and state identification cards may be updated using same requirements as birth certificates, with one-time amendment allowed per person; additional changes require court order.

• Persons changing names to conform with gender identity are exempted from public notice requirement for name changes; $58,500 appropriated to Division of Motor Vehicles for system maintenance; effective January 1, 2020.
