HB 19-1054: Disability Trust Requirements

• Clarifies that disability trusts must provide for the Department of Health Care Policy and Financing to receive reimbursement only upon the beneficiary's death, not during their lifetime.

• Requires that no person is entitled to payment from the trust remainder until both Colorado's medical assistance agency and any other state's medical assistance agencies are fully reimbursed for assistance rendered.

• Mandates that disability trusts comply with Title XIX of the federal Social Security Act (42 U.S.C. sec. 1396 et seq.) in addition to state law and applicable rules.

• Requires the Department of Health Care Policy and Financing or its designee to review and approve disability trusts to ensure compliance with state and federal requirements before the trust is valid.
