CO HB1100

Prohibits school district boards of education from including use restrictions that prevent district property from being used as a public or nonpublic school for preschool through grade 12 when selling, conveying, or leasing property

Requires school districts to provide public notice of intent to include such use restrictions and discuss the issue at a regularly scheduled board meeting before proceeding

Applies to all sales, conveyances, and leases of school district property on or after the effective date of the act

Takes effect August 2, 2019, unless a referendum petition is filed, in which case the act requires approval by voters at the November 2020 general election

Addresses concerns that deed restrictions lower property values and reduce funds available for teacher salaries, education programming, and facility maintenance
