CO HB1101

Prohibits employers from requiring union membership or payment of union dues as a condition of employment or continued employment.

Creates criminal penalties of up to $1,000 fine and/or up to 90 days in county jail for violations, and allows injured parties to sue for damages, injunctive relief, and attorney fees.

Authorizes the Attorney General and district attorneys to investigate alleged violations and prosecute offenders.

Declares all-union agreements unfair labor practices, except those approved by majority vote or three-fourths of voting employees in a secret ballot election supervised by the director.

Does not apply to employers and employees covered by the Federal Railway Labor Act, federal employers, employees in exclusive federal enclaves, or where federal law preempts the statute.
