HB19-1131 Summary

• Requires drug manufacturers, representatives, agents, and employees engaged in prescription drug marketing to provide prescribers with the wholesale acquisition cost of prescription drugs in writing when sharing drug information.

• Mandates that manufacturers also disseminate the names of at least three generic prescription drugs from the same therapeutic class (or as many as available) when providing required cost information.

• Defines "prescription drug marketing" to include in-person meetings, physical mailings, phone calls, video conferencing, emails, texts, and faxes, but excludes conversations at scientific conferences.

• Applies to health care providers licensed in Colorado who are authorized to prescribe controlled substances or prescription drugs.

• Takes effect August 2, 2019, unless a referendum petition is filed, in which case voter approval is required at the November 2020 general election.
