HB19-1140: Live and Let Live Act

• Establishes the "Live and Let Live Act" in Colorado to protect religious beliefs and moral convictions regarding marriage and biological sex from state government discrimination

• Defines protected beliefs as those regarding which individuals may marry and that male/female refer to immutable biological sex determined by anatomy and genetics at birth

• Prohibits state government from taking "discriminatory action" (including denial of tax benefits, contracts, licenses, accreditation, employment, or housing) against religious organizations and individuals who decline services related to marriage, adoption/foster care, or gender identity treatments based on sincerely held religious beliefs

• Provides remedies including declaratory relief, injunctive relief, compensatory damages, and attorney fees for those harmed by violations, with a two-year statute of limitations and waiver of sovereign immunity

• Applies broadly to religious organizations, sole proprietorships, partnerships, and closely held entities; supersedes conflicting state laws unless expressly exempted; takes effect August 2, 2019, subject to voter approval if a referendum petition is filed
