HB 19-1142 Summary: Kyle Forti Act

• Creates a Temporary Care Assistance Program allowing parents to voluntarily delegate parental responsibilities to an approved temporary caregiver through power of attorney without relinquishing legal custody.

• Limits delegation duration to a maximum of six months, except for military personnel on active duty who may extend until deployment ends plus 30 days.

• Requires child placement agencies operating the program to conduct fingerprint-based criminal history checks, child abuse and neglect background checks, and sex offender registry checks on all applicants and household members age 18 and older.

• Prohibits program use by parents named as respondents in open dependency and neglect cases and bars approval of caregivers with substantiated abuse/neglect allegations or disqualifying crimes.

• Appropriates $14,093 to the Department of Human Services for the 2019-20 fiscal year to implement the program with 0.3 FTE, effective August 2, 2019.
