HB 19-1167 Summary

• Authorizes notaries public to perform notarial acts on electronic documents for remotely located individuals using real-time audio-video communication.

• Notaries must notify the Secretary of State before performing remote notarizations and complete required training and examination.

• Notaries must verify identity through personal knowledge or satisfactory evidence including credible witness oath, government-issued ID with credential analysis, public key certificates, or other methods approved by the Secretary of State.

• Prohibits notaries and remote notarization system operators from using personal information collected during remote notarization for any purpose other than completing the notarial act or processing the related transaction.

• Effective January 1, 2021, but subject to referendum petition approval; does not permit remote notarization of electoral documents, wills, codicils, or certain acknowledgments.
