HB 19-1194 Summary

• Out-of-school suspension or expulsion of preschool through second grade students is prohibited except when the student possesses a dangerous weapon, uses/possesses/sells drugs or controlled substances, or endangers the health or safety of others.

• When suspension is permitted under the above conditions, it is limited to a maximum of 3 school days unless the executive officer determines a longer period is necessary to resolve a safety threat or recommends expulsion.

• Schools must consider alternative behavioral and disciplinary interventions on a case-by-case basis and document what alternatives were employed before suspending or expelling a student.

• The state board cannot waive the new suspension and expulsion requirements for preschool through second grade students, and these requirements apply to school districts, charter schools, and community-based preschool programs receiving state or federal funding.

• The act takes effect July 1, 2020, subject to voter approval if a referendum petition is filed within 90 days of the legislative session's end.
