HB 19-1226 Summary

• Removes possession of a weapon by a previous offender and certain sexual assault crimes from the list of non-bailable offenses.

• Creates presumption that defendants should be released with least restrictive conditions without monetary conditions unless court finds substantial risk of danger, flight, or obstruction and no reasonable nonmonetary conditions exist.

• Requires each judicial district to develop a pretrial screening process and chief judge administrative order establishing written criteria for immediate release without monetary conditions by July 1, 2020.

• Mandates all counties and cities establish pretrial services programs by July 1, 2020, with community advisory boards and minimum standards developed by the state court administrator.

• Appropriates $440,493 to the judicial department and $39,813 to the division of criminal justice for fiscal year 2019-20 to implement the act.
