HB 19-1253: Living Donor Protection Act of 2019

• Prohibits insurers regulated by the Colorado Division of Insurance from denying, limiting, or reducing coverage for persons who are living organ donors under life, disability income, health, or long-term care insurance policies.

• Bars insurers from requiring individuals to refrain from organ donation as a condition of obtaining insurance coverage or from considering donor status when setting premium rates.

• Prevents insurers from discriminating against living organ donors in offering, issuing, canceling, or determining the amount of coverage or price of insurance policies without additional actuarial risks.

• Requires the Division of Insurance and Department of Public Health and Environment to provide public information about insurance access for living organ donors and to distribute materials from recognized organ donation organizations.

• Takes effect August 2, 2019, and applies to all insurance policies and contracts entered into or renewed on or after the effective date.
