Removes the exception to landowner liability immunity that currently protects against willful and malicious failure to warn of known dangerous conditions on recreational land granted for free use.

Repeals Colorado Revised Statutes 33-41-104(1)(a), which exempted landowners from liability for willful or malicious failure to guard or warn against known dangerous conditions on their land.

Amends Colorado Revised Statutes 33-41-105(1)(a) to strike language protecting landowners from liability for willful or malicious failure to warn of known dangerous conditions on recreational land.

Applies to landowners who grant free access to their land for recreational purposes such as hunting, fishing, or camping, making them potentially liable for injuries resulting from known dangerous conditions they fail to warn about.

Takes effect August 2, 2019, or if subject to a referendum petition, becomes effective only upon approval by voters in the November 2020 general election.
