Each state agency and institution of higher education must submit a list of nondeveloped real property to the Capital Development Committee by October 15, 2019, and annually thereafter, with updates published on the General Assembly website.

The Division of Housing within the Department of Local Affairs must provide a link to the nondeveloped property report on its website and update the link by December 31 each year.

"Nondeveloped real property" is defined as unimproved property not protected for or dedicated to another use such as access or conservation easements.

For property tax years starting January 1, 2019, property tax exemptions for affordable housing owned by limited partnerships are revoked or terminated when income becomes available for distribution to partners or when the property is transferred.

The act takes effect September 1, 2019, unless a referendum petition is filed, in which case it requires voter approval at the November 2020 general election.
