HB 19-1335: Expungement of Juvenile Records

• Expands automatic expungement of juvenile delinquency records to apply within 42 days after dismissal prior to disposition or completion of sentence for petty offenses, drug petty offenses, and class 2-3 misdemeanors (excluding sexual offenses, domestic violence, and crimes under section 24-4.1-302).

• Streamlines the expungement process for diversion cases by allowing automatic expungement upon successful completion at the prefiling level without requiring a court order, with notification to relevant agencies within 35 days.

• Reduces the objection period from 84 days to 35 days for prosecutors and victims to challenge expungement eligibility in cases involving diversion, deferred adjudication, or informal adjustment.

• Extends expungement procedures to municipal courts for juvenile cases by creating a new section (13-10-115.5) requiring automatic expungement within 42 days for cases without victims and establishing a hearing process when objections are filed.

• Clarifies that expungement orders apply only to the named juvenile and not to co-participants, and establishes penalties for agencies that violate expungement orders knowing records should be sealed.
