SB19-033 Summary

• The state board of education must identify by rule which statutes and rules rural school districts may automatically waive without requesting individual waivers from the state board.

• Rural school district boards may invoke automatic waivers by adopting and transmitting a resolution to the state board and commissioner, and may apply waivers to the entire district or specific schools.

• Automatic waivers remain in effect until revoked by board resolution and cannot apply to charter schools or six specific statute categories including teacher evaluation systems, competitive bidding requirements, and school calendar provisions.

• Rural school districts invoking automatic waivers must post standardized descriptions, rationales, and contact information on their websites beginning July 1, 2020.

• The department of education must develop standardized descriptions and rationales for all statutes included on the automatic waiver list by July 1, 2020, working with a statewide school district association.
