SB 19-053 Summary

• Prohibits the Colorado Air Quality Control Commission from adopting motor vehicle emission standards that are more stringent than federal Environmental Protection Agency standards for the corresponding model year and vehicle class.

• Bars the commission from adopting California emission standards and test procedures unless they are identical to federal EPA standards for the same model year and vehicle class.

• Applies the prohibition to both emission standards rules and motor vehicle inspection and maintenance programs.

• Repeals existing statutory language in Colorado Revised Statutes 42-4-403(6)(a) that contained similar restrictions.

• Takes effect August 2, 2019, unless a referendum petition is filed, in which case it requires voter approval at the November 2020 general election.
