SB 19-090: Colorado Peer-to-Peer Car Sharing Act

• Establishes legal framework for peer-to-peer car sharing programs operating in Colorado, defining key terms including shared cars, drivers, owners, and the sharing period.

• Requires car sharing programs to assume liability for bodily injury, property damage, and uninsured/underinsured motorist losses during sharing periods up to amounts stated in agreements, but not less than minimum financial responsibility required by Article 7 of Title 42.

• Mandates car sharing programs maintain automobile liability insurance coverage of at least three times the minimum required financial responsibility, or ensure shared car drivers maintain minimum coverage.

• Requires car sharing programs to provide multiple disclosures to participants including terms and conditions, fees, insurance coverage details, safety information, and notification that personal automobile policies may not cover shared car usage.

• Establishes safety and operational requirements including driver's license verification, safety recall procedures, equipment responsibility, record retention for the duration of applicable statute of limitations, and airport concession agreements before operating at airports.
