SB19-093 Summary

• Clarifies that persons convicted of marijuana possession or use that was lawful under the Colorado Constitution are not prohibited from carrying firearms under state law.

• Establishes that medical marijuana users authorized under the Colorado Constitution are not considered ineligible to possess firearms under federal law nor deemed unlawful users of controlled substances for federal firearm eligibility purposes.

• Prohibits the Department of Public Safety from sharing confidential medical marijuana registry information with law enforcement agencies for background checks related to firearm transfers.

• Takes effect August 2, 2019, subject to referendum petition; if petitioned, requires voter approval at the November 2020 general election before taking effect.
