SB19-104 Summary

• Creates the Elimination of Duplicate Regulations Commission within the Department of Education to identify and reduce duplicate health and safety regulations across multiple state agencies.

• Commission membership includes the Commissioner of Education, Executive Directors of Human Services and Public Health and Environment, Director of Fire Prevention and Control, and at least three practitioners operating school-based child care programs in good licensing standing.

• Commission must analyze regulations from the Department of Education, Department of Human Services, Department of Public Health and Environment, and Division of Fire Prevention and Control related to school-aged child care programs operating on school property, including before/after school programs, camps, and playground programs.

• Requires the commission to prioritize public testimony, evidence-based research on child health and safety, and alignment with federal funding requirements when recommending which regulations to eliminate, revise, or delegate.

• By June 30, 2020, all affected agencies must commence rule-making proceedings based on commission recommendations; Article 101 automatically repeals on July 1, 2021.
