Senate Bill 19-109 Summary

• Amends Colorado Revised Statutes to adjust damage limitations for inflation on January 1, 2020, and every two years thereafter (previously adjusted only on January 1, 1998, and January 1, 2008).

• Applies inflation adjustments to civil liability limits under C.R.S. 44-3-801, noneconomic damages limits under C.R.S. 13-21-102.5, and damages limits under C.R.S. 13-21-203.7.

• Requires the Secretary of State to certify adjusted damage limitations within fourteen days after appropriate information becomes available, with each adjustment based on cumulative annual inflation since the original effective date.

• Rounds all adjustments upward or downward to the nearest ten-dollar increment.

• Takes effect August 2, 2019, unless a referendum petition is filed, in which case it requires approval by voters in the November 2020 general election.
