Qualified dependents of prisoners of war and military personnel missing in action may receive state tuition assistance benefits prior to receiving federal educational benefits under the Public Safety Officers' Benefits Act (34 U.S.C. § 10281 et seq.)

State tuition benefits for dependents of prisoners of war and missing military personnel must be reduced by the amount of any federal educational benefits the dependent receives.

Qualified dependents of deceased or permanently disabled National Guardsmen, law enforcement officers, and firefighters may receive state tuition assistance benefits prior to receiving federal educational benefits under the Public Safety Officers' Benefits Act.

State tuition benefits for dependents of deceased or permanently disabled National Guardsmen, law enforcement officers, and firefighters must be reduced by the amount of any federal educational benefits the dependent receives.

The act takes effect August 2, 2019, unless a referendum petition is filed, in which case it requires voter approval at the November 2020 general election to take effect.
