SB19-185 Summary

• Grants immunity from criminal liability and juvenile delinquency proceedings to minors under 18 charged with prostitution-related offenses if probable cause exists that they are victims of human trafficking for involuntary or sexual servitude.

• Creates affirmative defenses for trafficking victims to charges other than Class 1 felonies, allowing minors to prove by preponderance of evidence they were trafficking victims forced or coerced into criminal conduct.

• Requires law enforcement officers encountering minors engaged in prostitution-related conduct to immediately report suspected human trafficking of minors to county departments of human or social services or child abuse reporting hotlines.

• Adds definitions of "human trafficking of a minor for involuntary servitude" and "human trafficking of a minor for sexual servitude" to Colorado law and establishes these as forms of child abuse or neglect.

• Mandates legislative service agencies conduct a post-enactment review of the act's implementation five years after it becomes law.
