SB19-198 Summary

• Increases the maximum waste tire fee from $1.50 to $2.00 per tire, effective January 1, 2020 through December 31, 2025, with the fee reverting to $0.55 per tire on January 1, 2024.

• Creates the End Users Fund to provide quarterly rebates to in-state end users and retailers of tire-derived products, with rebate amounts set annually by the commission on a per-ton basis.

• Establishes a tiered rebate structure with Tier 1 providing full rebates for crumbed rubber and energy recovery uses, Tier 2 providing 50 percent rebates for molded products and rubber mulch, and Tier 3 providing 25 percent rebates for tire bales and alternative daily cover.

• Provides an additional $25 per ton rebate for waste tires obtained from rural counties (population under 60,000), subject to verification and documentation requirements.

• Terminates the End Users Fund and rebate program on December 31, 2025, with remaining fund balances transferred to the General Fund by July 1, 2026.
