HB 20-1001: Nicotine Product Regulations

• Raises the minimum age to purchase cigarettes, tobacco products, and nicotine products from 18 to 21 years old across all state laws and local jurisdictions.

• Requires state licensing for all retailers selling cigarettes, tobacco products, or nicotine products, effective July 1, 2021, with annual license fees set by rule (not exceeding $400-$600 per year).

• Establishes minimum 500-foot distance requirement from schools for new retail locations selling these products and prohibits external advertising of electronic smoking devices.

• Prohibits direct shipment or delivery of cigarettes, tobacco products, or nicotine products to consumers, with limited exceptions for licensed retailers making deliveries to persons 21 years or older.

• Increases enforcement penalties for retailers selling to minors, ranging from $250-$15,000 in fines plus sales prohibitions of 7-90 days or up to 3 years, depending on violation frequency within a 24-month period.
