HB 20-1010 Summary

• The Department of Corrections shall collect and maintain electronic records of incarcerated persons' legal residences (prior to incarceration) including street address, race, Hispanic origin status, and age.

• By May 1 of each decennial census year, the Department must deliver reports to nonpartisan legislative staff containing unique identifiers and residential address information for all state and contracted facility inmates, with data provided in electronic format.

• Nonpartisan staff shall adjust federal census data (Pub.L. 94-171) to count incarcerated persons at their legal Colorado residences rather than at correctional facilities, and must complete and publish this adjusted data within 30 days of receiving federal data.

• The adjusted census data shall be used by independent legislative and congressional redistricting commissions for redistricting purposes and made available to the public and local government entities upon request.

• The adjusted data shall not be used for distribution of state or federal aid, and individual prisoner information remains confidential under exception to Colorado Open Records Act.
