HB20-1033: Live and Let Live Act

• Establishes Colorado law protecting religious beliefs and moral convictions regarding marriage (defined as beliefs about which individuals may marry) and biological sex (defined as immutable biological sex determined by anatomy and genetics at birth).

• Prohibits state government from taking discriminatory action against religious organizations, individuals, and businesses that decline services related to marriage, adoption/foster care, healthcare, housing, or employment based on sincerely held religious beliefs or moral convictions about marriage and biological sex.

• Allows county clerks, judges, magistrates, and justices of the peace to seek recusal from authorizing or solemnizing marriages based on protected religious beliefs, with the Secretary of State required to ensure performance of lawful marriages is not impeded.

• Permits individuals to decline providing sex reassignment treatments, psychological counseling, or fertility services based on protected beliefs, though prohibits denial of emergency medical treatment, visitation rights, or healthcare decision-making designations.

• Authorizes affected persons to sue the state for violations, recovering declaratory relief, injunctive relief, compensatory damages, and attorney fees, with a two-year statute of limitations and waiver of state sovereign immunity (except Eleventh Amendment immunity).
