Amends Colorado Revised Statutes 16-7-302 to allow either party (defendant or prosecution) to withdraw from a plea agreement when the judge rejects any condition agreed to by both parties.

Currently, only the defendant is permitted to withdraw from a plea agreement if the judge declines to accept specific conditions.

When either party withdraws from the plea agreement, the judge must vacate any previously entered guilty or nolo contendere plea and reinstate all charges that existed prior to the plea agreement.

Applies to plea agreements entered into on or after the effective date of the act.

Includes a safety clause declaring the act necessary for immediate preservation of public peace, health, or safety.
