HB 20-1058: Behavior Analysts in Public Schools

• Requires administrative units to allow board certified behavior analysts to provide medically necessary services to students during school hours upon parent or legal guardian request.

• Each administrative unit must adopt a written policy by July 1, 2021, concerning behavior analysts providing medically necessary services during school hours.

• School district boards must solicit input from parents and community members and publicly discuss the policy at a regularly scheduled board meeting before adoption.

• Prohibits administrative units from entering into contracts or exclusive agreements with behavior analysts that restrict parents from choosing their own behavior analyst for their student.

• Takes effect August 5, 2020, unless a referendum petition is filed, in which case it requires voter approval at the November 2020 general election.
