• Establishes a physician-patient relationship between a physician who performs or attempts an abortion and any child born alive during or after the procedure, requiring the physician to exercise the same professional skill and care as with any other newborn at the same gestational age.

• Mandates that physicians immediately transfer any child born alive after an abortion to a hospital.

• Imposes a civil penalty of at least $100,000 per violation, enforceable by the attorney general who may also recover reasonable attorney's fees.

• Makes violation of the requirement a class 3 felony and establishes it as unprofessional conduct for licensing purposes.
