• Referral agencies must disclose to prospective residents all relationships with assisted living residences, including common ownership, financial interests, management arrangements, and familial ties.

• Referral agencies must disclose that they receive fees from assisted living residences for referrals and provide written documentation of the service agreement to the prospective resident or representative.

• Service agreements must include the right for prospective residents to terminate referral services at any time and require the referral agency to notify all referred facilities of any cancellation.

• Assisted living residences must not pay referral agency fees until receiving written documentation of required disclosures and must stop payment on or after the service agreement termination date.

• Assisted living residences must maintain copies of disclosure documentation for at least one year and cannot sell or transfer prospective resident contact information to third parties without written consent.
