HB20-1120: Enforcement of Sexual Exploitation of a Child

• Defines "sexual intrusion" as part of explicit sexual conduct and adds "livestream" to the definition of sexually exploitative material to reflect evolving technology.

• Creates new criminal prohibitions including accessing with intent to view, viewing, or controlling sexually exploitative material, with exceptions for law enforcement and licensed treatment professionals.

• Establishes sexual exploitation of a child as an extraordinary risk crime with enhanced presumptive sentencing ranges when material depicts children under 12, involves physical force/violence, or depicts sexual intercourse, sexual intrusion, or sadomasochism.

• Requires a sexual exploitation of children surcharge ($2,000 for class 3 felonies, $1,000 for class 4, $500 for class 5, $250 for class 6) on convictions or deferred sentences, with 95% deposited into a new surcharge fund.

• Appropriates money from the surcharge fund to the Colorado Bureau of Investigation to develop technological and expert resources for investigating and prosecuting computer-facilitated child sexual exploitation crimes.
