HB 20-1141 Summary

• Prohibits landlords from charging late fees unless rent payment is at least 14 calendar days late

• Caps late fees at the greater of $20 or 3% of monthly rent obligation (or 3% of remaining rent obligation amount)

• Prohibits landlords from evicting tenants, initiating eviction proceedings, or terminating tenancies solely for failure to pay late fees

• Prohibits late fees on rent portions covered by rent subsidy providers, requiring interest on late fees, and recouping late fees from rent payments; allows recoupment from security deposits only if late fee is no more than 180 days overdue with written notice

• Requires landlords to include unmetered utility service costs in rent and charge uniformly across all tenants receiving the service; restricts additional fees to use-based fees described in rental agreements
